Terms of Service

On Point Moto

These Terms of Service apply to your use of the On Point Moto website and to purchases made through our website, by telephone, by email or directly from On Point Moto.

By placing an order with us, you agree to these terms.

Nothing in these terms is intended to exclude or limit any statutory rights you may have as a consumer.

1. About On Point Moto

On Point Moto is a motorcycle dealership and retailer supplying motorcycles, motorcycle parts, accessories, clothing, riding equipment and related products.

Our contact details are available on our website.

2. Products & Product Information

We aim to ensure that product descriptions, photographs, specifications, prices and other information displayed on our website are accurate.

However, colours and appearance may vary depending on your device or screen.

Where a product is supplied with manufacturer specifications or information, these may change from time to time.

If you require clarification about a product before ordering, please contact us.

3. Prices

All prices displayed on our website are in British Pounds (£) and include VAT where applicable.

We reserve the right to change prices at any time, but changes will not affect an order that we have already accepted.

If a genuine pricing error occurs on our website, we will contact you before processing the order and give you the option to proceed at the correct price or cancel the order.

4. Orders

When you place an order through our website, you are making an offer to purchase the goods.

An automated order confirmation confirms that we have received your order. It does not necessarily mean that the order has been accepted.

We reserve the right to refuse or cancel an order where, for example:

  • The product is unavailable.
  • There has been an obvious pricing or listing error.
  • We are unable to obtain the product from our supplier.
  • There is a suspected fraudulent or unauthorised transaction.
  • We are unable to fulfil the order for reasons outside our reasonable control.

If we cancel an order after payment has been taken, we will issue a full refund.

5. Payment

Payment must be made using one of the payment methods available at checkout or otherwise agreed with On Point Moto.

For motorcycle purchases, deposits or alternative payment arrangements may be agreed separately.

We do not consider a motorcycle sale complete until the agreed payment and transaction arrangements have been fulfilled.

6. Delivery

Delivery arrangements and charges are set out in our Shipping Policy.

Orders over £150 qualify for free standard UK delivery, excluding complete motorcycles.

Complete motorcycles are subject to separate delivery or collection arrangements and delivery charges will be agreed with the customer before dispatch.

Estimated delivery times are not guaranteed where delivery is carried out by a third-party courier or transport provider.

7. Returns & Refunds

Returns and refunds are dealt with in accordance with our Returns & Refunds Policy.

Nothing in these Terms of Service removes or restricts any statutory consumer rights.

8. New Motorcycle Sales

New motorcycles sold by On Point Moto will be supplied as described and in accordance with applicable consumer law.

Where a manufacturer's warranty applies, the motorcycle will be supplied with the applicable manufacturer's warranty information and terms.

A manufacturer's warranty is additional to the customer's statutory rights against On Point Moto and does not replace them.

9. Used Motorcycle Sales

Used motorcycles are sold according to their individual age, mileage, condition, history and description.

A used motorcycle is not expected to be in the same condition as a new motorcycle.

Normal wear and tear consistent with the motorcycle's age, mileage, price and described condition does not automatically mean that a motorcycle is faulty.

We aim to provide accurate descriptions of used motorcycles and disclose known significant defects or issues.

Customers are encouraged to inspect a motorcycle carefully and ask any questions about its condition before completing a purchase.

Where a motorcycle is purchased remotely, customers may request additional photographs, videos or information where reasonably available.

Used motorcycles sold by On Point Moto to consumers remain subject to applicable statutory consumer rights.

10. Motorcycle Test Rides

Test rides may be offered at On Point Moto's discretion.

Any test ride will be subject to appropriate licensing, insurance and safety requirements.

On Point Moto reserves the right to refuse a test ride where we consider that the relevant requirements have not been met.

A test ride does not remove or waive any statutory consumer rights.

11. Motorcycle Deposits

A deposit may be requested to reserve a motorcycle.

The deposit amount and any specific conditions relating to the deposit will be explained to the customer before payment.

Where a customer cancels a motorcycle purchase outside any applicable statutory cancellation right, the treatment of the deposit will be determined by the terms agreed at the time the deposit was paid and the circumstances of the cancellation.

Nothing in this section removes or restricts any statutory consumer rights.

12. Motorcycle Collection & Delivery

Customers collecting a motorcycle from On Point Moto should inspect the motorcycle at the time of collection and raise any obvious issues with us.

Where a motorcycle is delivered, the customer should inspect the motorcycle upon delivery and report any obvious transport damage as soon as reasonably possible.

Inspection or collection does not remove statutory rights relating to faults that were not reasonably apparent at the time.

13. Part-Exchange

Where On Point Moto agrees to accept a motorcycle as a part-exchange, the agreed value will be recorded as part of the transaction.

Customers must provide accurate information about the motorcycle being offered as a part-exchange.

This includes, where applicable:

  • Ownership.
  • Outstanding finance.
  • Mileage.
  • Known mechanical faults.
  • Accident or damage history.
  • Modifications.
  • Previous use.
  • Service and maintenance history.
  • Any other material information relevant to the value or condition of the motorcycle.

The customer remains responsible for ensuring that any information supplied to us is accurate.

Where material information has been deliberately or materially misrepresented, On Point Moto reserves its rights under applicable law.

14. Motorcycle Finance

Where finance is available, any finance agreement will be subject to separate terms and approval by the relevant finance provider.

On Point Moto does not guarantee that a finance application will be approved.

The finance provider's terms will apply to the finance agreement.

15. Motorcycle Cancellation

Where a motorcycle is purchased directly from our premises, there is generally no automatic 14-day cooling-off period simply because a customer subsequently changes their mind.

Where a motorcycle is purchased under a genuine distance or off-premises contract, statutory cancellation rights may apply.

Where statutory cancellation rights apply, these will take precedence over any conflicting provision in these terms.

Customers wishing to cancel a remote motorcycle purchase should contact On Point Moto as soon as possible.

16. Faults & Statutory Rights

If you believe that a motorcycle or other product is faulty, damaged, incorrectly supplied or not as described, please contact us.

Consumer purchases are subject to the protections provided by applicable UK consumer law, including the Consumer Rights Act 2015 where applicable.

Depending on the circumstances, a consumer may have rights to repair, replacement, price reduction or refund.

Nothing in these Terms of Service limits or excludes those rights.

17. Business Purchases

If goods or a motorcycle are purchased wholly or mainly for business purposes, different legal rights may apply than those available to consumers.

Business customers should contact us if they require clarification of the terms applying to their purchase.

18. Website Use

You agree not to use our website:

  • For any unlawful purpose.
  • To attempt to gain unauthorised access to our systems.
  • To interfere with the operation or security of the website.
  • To submit fraudulent or misleading information.
  • To copy or reproduce website content without our permission.

We reserve the right to restrict or terminate access where we reasonably believe the website is being misused.

19. Intellectual Property

Unless otherwise stated, the content of the On Point Moto website, including text, photographs, graphics, logos and other material, belongs to On Point Moto or its relevant licensors.

You may not reproduce, distribute or commercially use our content without permission.

20. Events Outside Our Control

We will not be responsible for delays or failure to fulfil an obligation where this is caused by circumstances outside our reasonable control.

This may include, for example, courier disruption, extreme weather, industrial action, supplier failure, shortages, transport disruption, fire or other events beyond our reasonable control.

This does not affect your statutory consumer rights.

21. Changes to These Terms

We may update these Terms of Service from time to time.

The terms applying to your purchase will generally be those in force at the time you place your order, unless a change is required by law.

22. Governing Law

These Terms of Service are governed by the laws of England and Wales.

Any disputes will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory consumer protections that may apply.
